Sri Unni Krishnan, the learned Standing Counsel for the second and the third respondents, submits that the petitioner's passport is not renewed because of pending criminal proceedings, and when queried, the learned counsel submits that if in the pending proceedings there is permission to the petitioner to travel, the second respondent will consider and issue a Short Validity Passport within two weeks from the date of receipt of a copy of the permission. Sri Muzaffar Ahmed, the learned counsel for the petitioner, submits that the further proceedings in CC No.400/2023 are stayed by this Court in Criminal Petition No.215/2024. This Court must opine that whether the petitioner must travel when he has criminal proceedings against him must be considered - 4 - HC-KAR NC: 2026:KHC:8433 WP No.28984/2025 by the Court which is seized of the matter and in the present circumstances, it must be by this Court in Criminal Petition No.215/2024. Hence, the petition stands disposed of with liberty to the petitioner to file an application for permission to travel in such proceedings, calling upon the second respondent, if the petitioner files a copy of the permission, to consider the same and issue Short Validity Passport within two weeks from the date of receipt of such Order.
