By means of this writ petition, petitioner has sought the following reliefs:- “I. issue a order or direction for setting aside the impugned order dated 21-08-2015 and notice dated 15/01/2016 so far as it relates to the land and buildings of the petitioner. II. issue a writ, order or direction in the nature of mandamus directing the respondents to follow the provisions of The Right to fair Compensation and Transparency in Land Acquisition, Rehabilitation and resettlement Act, 2013, for acquisition of land for the purpose of National Highway no. 125, in district-U.S. Nagar. III. issue a writ, order or direction in the nature of mandamus directing the respondents to give the compensation for acquiring land (Gata no. 116) of the petitioner along with interest as per the provisions of The Right to fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, UKHC010061252018 2026:UHC:6344 2013.” 5. Learned counsels for the respondents point out that identical issue has been decided by this Court on 20.07.2026 in WPMS/270/2018, therefore, this writ petition can alos be decided in terms of that order. 6. Learned State Counsel has drawn attention of this Court to para 8 of the counter affidavit, filed by Mr. N.S. Nabiyal, Special Land Acquisition Officer/Competent Authority, Land Acquisition, Udham Singh Nagar, which is reproduced below:- “8. That the contents of para no. 11 of the writ petition as stated are not admitted. In reply thereto it is humbly stated that a notice under section 3E or 3H under the National Highway Act, 1956 issued to the petitioner in continuation of that the petitioner moved an application for the compensation of his acquired land area 0.0401 hect. as to the similar value to the co- tenure holder in the office of the answering responderit. Upon the application of the petitioner the compensation to the land of the petitioner was under the National Highway Act, 1956 and the amount of the compensation have been deposited in the Account No. 521002010058298 of the petitioner in Union Bank of India, Branch Khatima on 09.05.2016 and further an amount of the compensation determined under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 have been deposited the Account No. 521002010058298 of the petitioner in the Union Bank of India, Branch Khatima on 05.05.2018 by RTGS.” 7. Based on the averments made in the counter affidavit, learned State Counsel submits that the amount payable as compensation was determined by the Competent Authority and the compensation was released to the petitioner. He submits that petitioner had not challenged the determination made by the Competent Authority before any appropriate forum. UKHC010061252018 2026:UHC:6344 8. No rejoinder affidavit is filed by the petitioner, therefore, this Court has no option but the accept the averments made in the counter affidavit is true. 9. After payment of compensation and its acceptance by the petitioner(s), without any demur, the relief, as claimed, do not survive. 10. Accordingly, the writ petition fails and is dismissed.
