JUSTICE RAJESH SHANKAR ----- For the Petitioner : Mr. Anuj Burman, Advocate ----- Order No.12 Date: 12.01.2026 1. The present writ petition has been filed seeking following reliefs: “(i). For the issuance of an appropriate writ/order/direction to compensate the petitioner for the losses caused due to illegal sealing of the Rock Garden vide order dated 16.08.2006 without issuing any show cause notice to the petitioner and which was sealed up till 25.01.2007, the amount come to Rs. 50 Lakh approximately. (ii) For the issuance of an appropriate writ/order/direction commanding upon the respondents to compensate the petitioner for the losses caused due to damage done by the local people to the tune of rupees three crores. (iii) For the issuance of an appropriate writ/order/direction directing the respondent authorities to provide adequate security as ordered by the Deputy Commissioner by posting police personnel in the Rock Garden area so that the occurrence of illegal trespass and damaged by the unauthorized persons cannot re-occur and for the purpose that the visitors can go into the garden without any fear. 2026:JHHC:624 2 (iv) For the issuance of an appropriate writ/order/direction directing the respondent authorities forthwith remove the unauthorized construction and encroachment made inside the Rock Garden. (v) For the issuance of an appropriate writ/order/direction for quashing the order as contained in Letter No.282 dated 14.03.2007 issued under the Signature of the Secretary, Ranchi Regional Development Authority, Ranchi by which the petitioner has been directed to deposit a sum of Rs.Six lakhs for the settlement year 2006-07 and further to waive the lease fee for the period for which the Rock Garden has illegal been sealed by the respondent authorities and further restrain the respondents not to demand any settlement fees of the period during which the Rock Garden is under the process of development by the petitioner”. 2. Learned counsel for the petitioner submits that so far as the prayer nos.(iii), (iv) and (v) are concerned, the same have already been redressed. So far as the prayer nos.(i) and (ii) are concerned, he may be permitted to withdraw the present writ petition with liberty to the petitioner to pursue the said grievance before the appropriate forum. 3.
