By means of present petition, petitioner has impugned the order dated 23.05.2026 passed by respondent no.2 whereby petitioner’s representation dated 23.04.2026 (preferred in compliance of this Court’s order dated 22.04.2026 passed in WPSS No.639 of 2026) was rejected. Petitioner has also challenged the order dated 19.05.2026 passed by respondent no.2 (Annexure No.8 to the petition) whereby prayer for grant of subsistence allowance to the petitioner, towards his suspension, has been turned down. 2. Learned senior counsel for petitioner submitted before this Court on previous occasion i.e. on 21.07.2026, that son of petitioner is suffering from Autism which is a serious mental ailment, but even though, petitioner has been attached to the office of Deputy Education Officer, Sitarganj which is 120 kilometers away from the place of his posting i.e. Jaspur. 3. This Court having considered the said submission, particularly illness suffered by petitioner’s

2026:UHC:6373 2 son, has given three days’ time to learned State Counsel to get instruction to accommodate the petitioner in and around the place Jaspur pursuant to his suspension. 4. Today, learned State Counsel passed on to this Court instruction/order dated 24.07.2026 passed by District Education Officer, Primary Education, Udham Singh Nagar, which is taken on record. 5. On the basis of said instruction, learned State Counsel submits that earlier order of attachment of petitioner has been amended and he has now been attached to the office of Deputy Education Officer, Rudrapur, Udham Singh Nagar. 6. The prayer made by petitioner has been considered and acted upon by the respondents-State. In such view of the matter, the writ petition is disposed of finally. However, it is directed that if petitioner joins in the office of Deputy Education Officer, Rudrapur, Udham Singh Nagar, the subsistence allowance and its arrears shall be paid to him within 10 days from the date of his joining, in accordance with law. 7. Pending application stands disposed of.
