After some arguments, Mr. N. Brojendro, learned Senior Standing Counsel for Customs sought leave of this Court to withdraw captioned ‘Miscellaneous Case’ (‘MC’ for the sake of brevity) as certain errors have been crept inter-alia in the prayer but makes a request to preserve all the rights and contentions of MC applicant to file MC afresh after making a course correction. This request of learned counsel on record for MC applicant is acceded to. [2]
