Mr. Chandramauli Shah, learned counsel for the applicant. 2. Mr. Tumul K Nainwal, learned AGA, for the State of Uttarakhand. 3. This is the second bail application. The first bail application was dismissed as withdrawn. 4. The present applicant – Sachin Kumar S/o Darpan Ram, is praying for bail in reference to FIR dated 04.07.2024 bearing FIR No.0013 of 2024, Police Station Didihat, District Pithoragarh, wherein, after investigation the applicant has been chargesheeted and summoned to face the trial for the offences punishable under Sections 376 of IPC read with Section 5/6 of the POCSO Act, in Special Session Trial No.36 of 2024. 5. Now the present applicant is seeking bail on the ground that a settlement has been arrived in between the family members of the applicant and the victim that after attaining the age of majority, the applicant will marry with victim. Learned counsel for the applicant submits that on the basis of the settlement arrived in between the parties in C528 No.1478 of 2026, the proceedings of trial court is stayed by the coordinate Bench on 13.07.2026. 6. On the other side, learned AGA also fairly submits that the coordinate Bench on the basis of the settlement arrived in between the family members of both the applicant and the victim stayed the proceeding on 13.07.2026. 7. After hearing the submissions of the learned counsel for the parties, and taking into consideration that the settlement has been arrived in between the parties, which is reflected from the order dated 13.07.2026, passed in C528 No.1478 of 2026, therefore in such an eventuality this Court is of the view that the applicant deserves for bail. 8. Accordingly without expressing any opinion on the merits of the case, bail application is allowed. 9. Let the applicant – Sachin Kumar, be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount to the satisfaction of the Court concerned.
