JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioner – accused is before this Court calling in question proceedings in C.C.No.2447/2023, pending before the VI Additional Chief Metropolitan Magistrate, Bengaluru, for the offences punishable under Sections 504 and 507 of the IPC. 2. Learned counsel for the petitioner and respondent No.2 would in unison submit that during the subsistence of these proceedings, the parties to the lis have entered into settlement amongst themselves by drawing up certain terms and conditions. The parties have filed an application under Section 320 r/w. 482 of the Cr.P.C. along with a joint affidavit - 3 - HC-KAR NC: 2026:KHC:16820 CRL.P No. 8030 of 2025 before this Court seeking permission for compounding of offences. 3. The joint affidavit reads as follows: “5. We state that, in the mean-time, the petitioner and respondent have arrived at a compromise with the due intervention of elders and common friends of both the petitioner and the respondent. Due to said amicable settlement between them, the petitioner and the respondent have agreed to settle their dispute inter se. 6. We state that, continuation of the proceedings will cause great hardship in our lives and the outcome of the case will deteriorate the spirit of us. Therefore, we have sought for quashing the proceedings. Wherefore, it is prayed that this Hon'ble Court may be pleased to allow the above petition quashing the proceedings in CC No.2447/2023 based on the Crime No.220/2022 pending on the file of the IV Additional Chief Judicial Magistrate at Bangalore.” In the light of the afore-quoted joint affidavit of the parties, as the dispute is between the individuals and the allegations are not against the State, I deem it appropriate to obliterate the crime registered against the petitioner in the subject petition. - 4 - HC-KAR NC: 2026:KHC:16820 CRL.P No. 8030 of 2025 4. For the aforesaid reasons, the following: O R D E R (a) The criminal petition is disposed.
