UKHC010131912026 2026:UHC:6403 SL. No. Date Office Notes, reports, orders or proceedings or directions and Registrar’s order with Signatures COURT’S OR JUDGE’S ORDERS WPCRL/1470/2026 Sonam And Anr --Petitioner Versus State Of Uttarakhand --Respondent Hon'ble Alok Mahra, J. Mr. Shubhr Rastogi, learned counsel for the petitioners. Mr. S.C. Dumka, learned A.G.A. assisted by Mr. Nikhil Bisht, learned Brief Holder for the State of Uttarakhand. 2. The petitioners have approached this Court seeking the following reliefs: "i. Issue a writ, order or direction in the nature of mandamus commanding respondent Nos. 1 and 2 to provide adequate protection to the life and personal liberty of the petitioners. ii. Issue a writ, order or direction in the nature of mandamus commanding the private respondents not to interfere with the life and personal liberty of the petitioners." 3. Learned counsel for the petitioners submits that both the petitioners are major. Petitioner No. 1 professes the Muslim faith, whereas petitioner No. 2 professes the Hindu faith. It is submitted that they are residing together in a live-in relationship at Village Shekhpur, Laksar, District Haridwar. Although petitioner No. 2 originally belongs to District Muzaffarnagar, it is submitted that he has been residing at the aforesaid address for more than one year. In support of the said contention, learned counsel has placed on record a rent agreement. It is further submitted that the petitioners have registered their live-in relationship under Registration No. LR- UKUCC26000000104, wherein their address has been recorded as Village Shekhpur, Post Office and Tehsil Laksar, District Haridwar. Learned counsel further submits that the petitioners UKHC010131912026 2026:UHC:6403 apprehend a threat to their life and personal liberty at the hands of respondent Nos. 3 to 9. Accordingly, the petitioners seek appropriate directions for protection of their life and personal liberty. 4. Having heard learned counsel for the parties and upon perusal of the material available on record, this Court, in the light of the law laid down by the Hon'ble Supreme Court in Lata Singh v. State of U.P. and Another, is prima facie of the opinion that the petitioners have made out a case for protection of their life and personal liberty guaranteed under Article 21 of the Constitution of India. 5. Accordingly, the Station House Officer, Police Station Kotwali Laksar, District Haridwar, is directed to assess the threat perception, if any, to the life and personal liberty of the petitioners. In the event any genuine threat is found to exist, adequate protection shall be provided to the petitioners strictly in accordance with law. The Station House Officer shall also summon respondent Nos. 3 to 9, as well as any other person found to be interfering with or threatening the petitioners, and counsel them to maintain peace and refrain from taking the law into their own hands. It is, however, clarified that this order shall not be construed as conferring any imprimatur upon the live-in relationship of the petitioners or as adjudicating upon any of their civil or personal rights, which shall be governed by the applicable law. 6. With the aforesaid directions, the present Criminal Writ Petition stands disposed of.
