JUSTICE SOUMITRA SAIKIA ORDER 24.06.2026 Heard Mr. D Gogoi, learned counsel for the petitioner. Also heard Ms. B Sharma, learned CGC for the respondents. The petitioner is before this Court challenging the order dated 22.12.2025 whereby the petitioner was transferred from his present place of posting in Guwahati to 116 Battalion presently located in Jammu & Kashmir. The ground seeking re-consideration of the transfer order is that his elder daughter is in the mid-academic year of Class-XII standard at P&C Academy, Beharbari, Guwahati. His daughter is presently residing with him in quarter, GC CRPF. His wife is also not available with the petitioner as she is the caregiver to his 70 years old mother of the writ petitioner who is suffering from cancer and undergoing treatment at Barpeta. His younger daughter is with his mother. It is submitted that because of these reasons, the petitioner has filed a representation before the authorities praying for re-consideration of his transfer order which however was not considered and was rejected and consequently, the petitioner has approached this Court by filing this present writ petition. Page No.# 3/3 Considering the grounds urged save and except to the extent that the petitioner's daughter is presently studying in Class XII in a private school and the academic session is midway, this Court is not persuaded to interfere with the impugned transfer order. Therefore, this Court is of the considered view that two (2) months time be granted to the petitioner to make alternative arrangements in respect of his domestic responsibilities. Accordingly, the writ petition stands closed permitting the petitioner to make all necessary arrangement within the period prescribed by the Court. The release order of the writ petitioner pursuant to the transfer order dated 22.12.2025 shall not be given effect to till 31.08.2026. Needless to say that the interim protection granted to the petitioner stands automatically vacated after 31.08.2026 without further reference to this Court. Since the movement order and transfer order is stayed, the petitioner be permitted to re-join his unit in Guwahati till 31.08.2026. JUDGE Comparing Assistant
