ORAL ORDER
Parties present. Joint memo filed. Joint memo reads as under:
“The above named parties beg to submit that, out of the Court the parties are agreed to settled the matter a sum of Rs.3,55,000/- (Rupees three lakhs fifty five thousand) as full and final settlement. Out of which the petitioner has paid a sum of Rs.1,87,500/- by way of DD deposited before the Trial Court. The petitioner agreed to pay a balance amount of Rs.1,68,000/- (Rs.one lakhs sixty eight thousand only) to the respondent within 3 months from this day by way of Account Transfer without fail. In future there is no financial dues from the petitioner. The petitioner in default to pay the balance amount of Rs.1,68,000/- (Rs.one lakhs sixty eight thousand only) to the respondent, the respondent liberty to take appropriate action against the petitioner.
Therefore, it is prayed that this Hon’ble Court may be pleased to dispose of the above petition in terms of the joint memo as agreed by the parties and set aside

the sentence passed by the Courts below. Hence, this Joint Memo.”
2. Placing the joint memo on record, revision petition stands
disposed of.
3. Amount in deposit is ordered to be withdrawn by the complainant under due identification.
4. It is made clear that if the amount mentioned in the joint memo is not paid, revision petitioner shall undergo imprisonment as ordered by the Trial Court confirmed by the First Appellate Court.
