The petitioner is apprehending his arrest in connection with Panki P.S. Case No.128 of 2025, for offence registered under sections 319(2), 318(4) of BNS, 2023, section 15(2)(B) of Indian Medical Council Act and Section 23 of Pre Conception and Pre Natal Diagnostic Techniques (PCPNDT) Act, pending in court of learned Judicial Magistrate First Class, Palamau at Daltonganj. 3. Learned counsel for petitioner submits that the petitioner happened to be Care-taker of Bharat Ultrasound, Panki, in the district of Palamau. He further submits that false allegation is made against the petitioner of being the proprietor of the said Ultrasound centre. He also submits that the allegations are made that the doctor has not done the ultrasound of the lady and it has come in 2026:JHHC:271 2 the order of the learned Sessions Judge that Dr. Ravi Shankar Kumar having registration no.30272 was running the said Ultrasound center and he was not present at the time of doing the ultrasound. He also submits that notice under section 35(3) of BNS, 2023 was issued to the petitioner. 4. Learned State counsel opposes prayer and submits that the allegations are there against the petitioner and the petitioner happened to be the operator of the said Ultrasound. 5. It has come in the order of the learned Sessions Judge that said Dr. Ravi Shankar Kumar was competent person and that has come in paragraph no.5 of the case diary and the petitioner is said to be care-taker of the said Ultrasound centre and at the time of ultrasound of the said lady the doctor was not present and all these facts have come in the order of the learned Sessions Judge and the petitioner has received notice under section 35(3) of the BNS, 2023, and in that view of the matter, the petitioner is directed to surrender before the learned court concerned within three weeks from today, and the learned court concerned shall release the petitioner on such terms and conditions as well as the sureties as the learned court concerned may deem fit and proper. 6.
