1. This criminal misc. bail application has been filed by the petitioner Rameshvari Devi W/o Sugna, aged about 65 years, who was arrested by the police in connection with the FIR bearing No.43/2026 dated 25.03.2026 registered at Police Station Arain, District Ajmer for the offences punishable under Section 115(2), 126(2), 351(2) & 189(2) of B.N.S., 2023. The bail application filed by the petitioner herein was rejected by the Additional Session Judge No.1, Kishangarh, District Ajmer, vide order dated 30.05.2026, thereafter, the petitioner has preferred this bail application under Section 483 of B.N.S.S., 2023.

Learned counsel for the petitioner submits that the present FIR has been lodged by the family members of the petitioner herein in respect of some petty verbal altercation that took place on the date due to which the alleged incident occurred.

Learned counsel further submits that the parties have amicable settled the dispute between them and they are family members. Therefore, the counsel for the complainant, as present in person while supporting this fact, does not dispute the settlement as well as oppose the present bail application. In view thereof, learned counsel prayed that the accused-petitioner be enlarged on bail.

This Court, after considering the above facts and noticing that the petitioner is complainant are family members and petitioner are almost 65 years of age, without commenting upon the merits of the case is inclined to exercise its power under Section 483 B.N.S.S. and deems it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is directed that accused-petitioner Rameshvari Devi W/o Sugna shall be released on bail, provided he executes a personal bond in a sum of Rs.1,00,000/-with two sound and solvent sureties of Rs.50,000/- to the satisfaction of learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
6. The petitioner is further directed not to take undue advantage of liberty or misuse liberty. It is made clear that the observations as made by this Court in the bail application will not affect trial of the case.
