Mr. Sanjay Kumar Arya, learned counsel for the applicant. 2. Ms. Meenakshi Sharma, learned AGA, for the State of Uttarakhand. 3. The present applicant – Anil Rawat S/o Shri Soban Singh Rawat, is praying for bail in a reference to FIR dated 19.05.2026 bearing FIR No.11 of 2026, Police Station Salt, District Almora, wherein, the applicant has been implicated for the offences punishable under Sections 8/20/60 of the NDPS Act. 4. It is argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated and the alleged contraband, which is shown to be recovered is non commercial quantity i.e. 17 kg ganja, however there is no substantial compliance of mandatory provision of NDPS Act and the applicant is languishing in jail since 19.05.2026. He further submits that the co-accused Gaurav Rawat, was granted bail by this Court on 17.07.2026 in BA 1st No.1018 of 2026 and claims benefit of parity. 5. On the other side, learned AGA have also not disputed that applicant is languishing in jail since 19.05.2026 and the other co-accused has been granted bail by this Court. She further submits that the applicant has one criminal antecedent, in which the applicant was already enlarged on bail. 6. After hearing the submissions of the learned counsel for the parties, and taking into consideration that co-accused has been enlarged on bail and the applicant is languishing in jail since 19.05.2026, this Court is of the view that the applicant deserves for bail. 7. Accordingly without expressing any opinion on the merits of the case, bail application is allowed. 8. Let the applicant – “Anil Rawat”, be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount to the satisfaction of the Court concerned.
