The present bail application has been filed under Section 483 BNSS, 2023 against the order dated 05.05.2026, passed by the learned Session Judge, Sawai Madhopur, in Bail Application No. 405/2026, whereby the bail application of the petitioner was rejected in connection with F.I.R. No. 126/2026 registered at Police Station-Bonli, District-Sawai Madhopur, for the offences under Sections 318(4), 319(2), of BNS, 2023 and Section 66D of the Information Technology (Amendment) Act, 2008. 2. Learned counsel for the petitioner submits that only one complaint has been registered against the petitioner on the National Cyber Crime Reporting Portal, involving an amount of Rs. 6,178/-. He further submits that the petitioner has no criminal antecedents and has never been involved in any offence of a similar nature or otherwise. He also submits that the offences [2026:RJ-JP:23268] (2 of 3) [CRLMB-7663/2026] alleged are triable by the Magistrate, the charge-sheet (challan) has already been filed, and the conclusion of the trial is likely to take a considerable amount of time. Therefore, he prays that the petitioner be enlarged on bail, particularly in view of the fact that he has been in judicial custody since 01.05.2026. 3. Learned Public Prosecutor vehemently opposes the bail application. 4. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 5. Without expressing any opinion on the merits of the case and having regard to the submissions advanced by learned counsel for the parties, as well as the fact that the offences are triable by the Magistrate, the amount involved is only Rs. 6,178/-, the charge- sheet (challan) has already been filed, and the petitioner has no criminal antecedents, this Court is of the opinion that the present bail application deserves to be allowed. 6. Consequently, the present bail application is allowed. It is ordered that the petitioner namely-Brahm Singh S/o Hansraj arrested in connection with F.I.R. No. 126/2026 registered at Police Station Bonli, District-Sawai Madhopur, shall be released on bail; provided he furnishes a personal bond of Rs.1,00,000/ (Rupees One Lakh Only) with two sureties of Rs.50,000/ (Rupees Fifty Thousand Only) each, subject to the satisfaction of the learned Trial Court, with the stipulation that he shall appear before the said Court on all dates of hearing and as and when called upon to do so until completion of the trial, subject to the following conditions: [2026:RJ-JP:23268] (3 of 3) [CRLMB-7663/2026] (i) The petitioner shall not leave country without the prior permission of the Court; (ii) The petitioner shall not commit any offence similar to the offence of which he is accused or suspected to have committed; (iii) The petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing those facts to the Court or to any police officer or tamper with the evidence; and (iv) In the event the petitioner is found involved in any other cyber fraud case in the future, the prosecution shall be at liberty to move an appropriate application before the learned Trial Court for cancellation of the bail granted herein.
