This is second bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant in Crime No.242/2025 registered at Police Station Surajpur, District Surajpur (CG) for the offences under Sections ALLENA ANNAJEE RAO Digitally signed by ALLENA ANNAJEE RAO Date: 2026.03.25 18:06:39 +0530 2 65(1), 127(2), 3(5) of BNSS 2023 and Section 4(2), 17 of the POCSO Act, 2012. 2. As per the prosecution case, on 19.05.2025, complainant lodged a report alleging that on 18.05.2025 accused Manish Singh had committed sexual intercourse with her minor daughter while the present applicant assisted in commission of offence. Based on that report, the offence was registered against both the accused persons and the applicant was arrested on 19.05.2025. 3. Learned counsel for the applicant submits that the first bail application was dismissed by order dated 21.01.2026 passed by this Court in M.Cr.C.No. 323/2026. Thereafter, main accused Manish Singh has been granted bail on 03.02.2026 in M.Cr.C.No.610/2025. She further submits that it is clear from the court statement of the victim that the main allegation is against accused Manish and the allegation against the present applicant is that he had merely assisted the main accused Manish Singh. She submits that the applicant is in jail since 19.05.2025; there is no immediate possibility of disposal of case and further looking to the nature of allegation, the present applicant may be enlarged on bail. 4. Per contra, learned State Counsel opposes the bail application. However, he does not dispute the fact that the main accused has been granted bail by this Court. 5. On 24.03.2026, the victim along with her mother has appeared through VC from the concerned DLSA and expressed no-objection to grant bail. 3 6. Having considered the submissions made by learned counsel for the parties and further looking to the court statement of the victim which shows the nature of allegation levelled against the applicant as also the fact that main accused Manish has been enlarged on bail by this Court, without observing anything on the merits of the case I am inclined to release the applicant on regular bail. 7. Accordingly, this bail application is allowed and the applicant Shobhit Singh, is directed to be released on bail on his furnishing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court for his appearance before the said Court as and when directed in that behalf.
