Mr. Sabyasachi Chatterjee, Mr. Kiran Sk., Mr. Sayed Hussain, Mr. Jamiruddin Sk. …..for the Defacto complainant. 1. Learned Senior Advocate appearing for the petitioners submits that the petitioners are in custody for about 236 days and the petitioners are similarly placed with other accused persons being members of the family who have been implicated in connection with the instant case. 2. Learned Advocate for the State has drawn attention of this Court to the statements of the eyewitnesses as well as the other post occurrence witnesses. 3. Learned Advocate for the defacto complainant opposes the prayer for bail and submits that the accused 2 persons threatened the defacto complainant and other witnesses of the case. 4. Be that as it may, I have taken into account the weapons, which have been seized, being bamboo and iron rod at the behest of the present petitioners as also the nature of injury as appearing in the post mortem report. I have considered the period of detention of the present petitioners and there is no possibility of the trial concluding in near future. Considering the nature of injuries in the post mortem report, I am of the view that further detention of the petitioners is unwarranted. 5. Accordingly, the prayer for bail is allowed. 6. Accordingly, the petitioners viz, Asgar Sk. @ Haru Sk., Amanat Sk., Tanjil Sk. shall be released on bail upon furnishing bond of Rs.20,000/-each, with two sureties of Rs.10,000/-each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Jangipur, Murshidabad and on further condition that the petitioners shall not enter the jurisdiction of Raghunathganj Police Station without the permission of the Court in seisin of the case except for the purpose of attending Court proceeding. 7. If on bail, the petitioners shall be physically present on each and every date so fixed by the learned Trial Court and shall not leave the jurisdiction of the district of 3 Murshidabad without prior permission of the learned Trial Court. 8. The application for bail, being CRM (M) 109 of 2026 is, thus, disposed of. 9. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
