1. The instant bail applications have been filed by the petitioners Mariyam W/o Hakku and Arsad S/o Isloop, who were arrested by the police in connection with the FIR bearing No.582/2021 dated 28.09.2021 registered at Police Station Kaman, District Bharatpur for the offences punishable under Sections 143, 341, 323, 451 and 336 of the BNS, 2023.

Learned counsel submits that the complainant has named as many as 35-40 persons in the FIR without leveling any specific allegations, out of them about 15-20 persons have been enlarged
[2026:RJ-JP:23434] (2 of 2) [CRLMB-8447/2026] on bail either by the learned Trial Court or the Co-ordinate Benches of this Court. In view thereof, he claims parity and prays that the petitioners may be enlarged on bail by this Court.
3. Learned Public Prosecutor strongly opposes the bail application.
4. Heard learned counsel for the parties.

This Court, considering the fact that there are no specific allegations in the FIR and the levelled allegations also are of general nature registered against more than 35-40 persons, there are no criminal antecedents against the petitioner and without commenting upon the merits of the case, is inclined to enlarge present petitioners on bail.

Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is directed that accused-petitioners Mariyam W/o Hakku and Arsad S/o Isloop shall be released on bail, provided each of them execute a personal bond in a sum of Rs.1,00,000/-with two sound and solvent sureties of Rs.50,000/- each to the satisfaction of learned Trial Court for their appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. The petitioners are further directed not to take undue advantage of liberty or misuse liberty.
7. It is made clear that the observations as made by this Court in the bail application will not affect the trial of the case.
