This application has been filed under section 483 of the Bharatiya Page No.# 2/3 Nagarik Suraskha Sanhita, 2023, whereby the accused petitioner namely, Rejia @ Reziya Khatun, has prayed for bail in connection with Basistah P.S. Case No. 138/2026 u/s 20(b)(ii)(B)/29 of NDPS Act. 3. The petitioner was arrested on 02.05.2026. 4. The allegation in the FIR dated 01.05.2026 lodged by S.I. Ankur Barman was that upon receiving a secret information about selling of illegal drugs, the police team proceeded to the area and found the petitioner coming on a two-wheeler and upon seeing the police, she threw away a bag and tried to flee whereupon, she was apprehended along with one bag and the other bag fell in the nearby river stream. 5. The learned counsel for the petitioner submits that she has already spent 53 days in custody and the place where she was arrested is different from the place where seizure was made. 6. The case diary has been received. 7. The learned Additional Public Prosecutor for the State submits that one of the bags thrown by the accused petitioner was recovered from the place of occurrence and another fell on the river and the police seized the same at a subsequent point alongside the river. It is submitted by the prosecution that the petitioner was also prosecuted in another NDPS case. The informant has supported the allegations made in the FIR and also filed a bail objection against the prayer of the petitioner. The seizure witnesses have also supported the allegations about seizure of contraband. Page No.# 3/3 8. I find force in the contention of the prosecution and the bail objection filed by the I/O. The investigation is in progress. Accordingly, the bail petition stands rejected at this stage. 9. Send back the case diary. JUDGE Comparing Assistant
