(Oral) Petitioner is working as Assistant Teacher, L.T. Grade (Mathematics) with the respondent-Education department and is presently posted at Government Inter College, Dhanaulti, Block Jaunpur, District Tehri Garhwal. 2. Petitioner has filed the present writ petition alleging that he has put in more than 24 years in service as Assistant Teacher, L.T.Grade (Mathematics) and as per the Rule 5 of the provisions of the Uttarakhand State Educational (Teaching Cadre) Gazetted Services Rules, 2022, (as amended up to date), he is eligible for promotion to the post of Principal of the Intermediate College as he fulfills all the eligibility criteria mentioned in the Rules. 3. Learned counsel for petitioner contends that for the said purpose, respondent-department has to conduct the Limited Departmental Promotional Examination. Earlier the advertisement was issued by the respondent No.3- Public Service Commission on the requisition sent to it on 11.03.2024, but, subsequently, due to judgment passed by Hon’ble Apex Court on 01.09.2025 in Civil Appeal No.1385 of 2025 Anjuman Ishaat-e-Taleem Trust v. State of UKHC010126552026 2026:UHC:6374 2 Maharashtra & Ors., the requisition was withdrawn by the State Government and subsequently, respondent No.3- Public Service Commission has returned the said requisition to the State Government. Now, by means of the present writ petition, petitioner wants the State to resend that requisition to respondent No.3 for promotion on the post of Principal in Government Intermediate College through Limited Departmental Promotional Examination. 4. Learned counsel for petitioner submits that petitioner has sent representation to the respondent No.1- Secretary, School Education Department, copy to respondent No.2-Director, Secondary Education, on 29.06.2026 (Annexure No.8 to the writ petition), making the said prayer. 5. It is contended by learned counsel for petitioner that the said representation of the petitioner is still pending. He submits that if a time bound direction is issued to respondent No.1 to take a decision on the said representation of petitioner, the ends of justice would be met. 6. There is no opposition from the side of respondents-State if such an order be passed by this Court. 7. Accordingly, the present writ petition is disposed of finally. Respondent No.1-Secretary, School Education Department, is directed to take a decision on petitioner’s representation dated 29.06.2026 (Annexure No.8 to the writ petition), within two months from the date of production of certified copy of this order.
