Dhanbad. ....Petitioner Versus The State of Jharkhand. ....Opp. Party --------- CORAM: HON’BLE MR. JUSTICE DEEPAK ROSHAN --------- For the Petitioner : Mr. Shailesh Kr. Singh, Advocate For the Opp. Party : Ms. Shweta Singh, A.P.P. --------- 03/Dated:-25.02.2026 1. Heard learned counsel for the parties. 2. The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Section 318(4) / 338 / 336(3) / 336(4) / 340(2) / 61(2) / 3(5) of B.N.S. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he has committed no offence as alleged in the F.I.R. He further submits that he has been implicated merely on the basis of conjectures and surmises and the petitioner is merely the driver of the vehicle. He further submits that the petitioner has got no criminal antecedents and the co-accused having more allegations has already been granted anticipatory bail in A.B.P. Case No. 05 of 2026 and the petitioner for no offence has been languishing in custody since 30.11.2025; as such, the petitioner may be enlarged on bail. He submits that the petitioner is ready to abide by every condition as imposed by this court. 4. Learned A.P.P. opposes the prayer for bail of the petitioner. 5. Having regard to the facts of the case and looking to the allegations made against this petitioner coupled with the fact that the petitioner is only the driver of the alleged vehicle and he has got no criminal antecedents and also the co-accused person who is having more allegations, has already been granted anticipatory bail; therefore, I am inclined to enlarge this petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Dhanbad in connection with Jharia P.S. Case No. 327/2025. 6. It is made clear that the petitioner shall appear on each and every date before the learned trial court and he shall not threaten any witnesses and shall co- operate in trial and if any adverse report will come against this petitioner, learned trial court shall be at liberty to cancel the bail of this petitioner.
