(At present petitioner is confined in District Jail Karauli). ----Accused-Petitioner Versus 1. State of Rajasthan - through Public Prosecutor ----Non Applicant For Petitioner(s) : Mr. Raj Kumar Kasana For Respondent(s) : Mr. Vijay Singh Yadav, P.P. HON'BLE MR. JUSTICE RAVI CHIRANIA (V.J.) Judgment / Order 18/06/2026 1. This misc. bail application has been filed by the petitioner Shiv Charan son of Late Shri Ramkishan, aged about 60 years, who was arrested by the Police in connection with the FIR bearing No.0026/2026 dated 19.01.2026 registered at Police Station Karauli, District Karauli for the offences punishable under Sections 318(4), 338 and 336(3) of B.N.S., 2023. 2. Learned counsel submits that the bail application filed by the petitioner was rejected by the learned Additional Sessions Judge, Karauli vide order dated 14.05.2026, thereafter, the petitioner has preferred this bail application under Section 483 of B.N.S.S., 2023. 3. Learned counsel submits that the petitioner was arrested for an incident dated 19.12.2025. Learned counsel also submits that the allegation against the petitioner is that he gave an affidavit [2026:RJ-JP:23367] (2 of 3) [CRLMB-8044/2026] stating therein that the recorded Khatedar has no legal representative and on account of that, the said land was mutated in the name of the co-accused persons. Learned counsel submits that as far as pendency of the cases registered against the petitioner are concerned, they are of the year 1997 and 2001, which have already been decided and there is no case pending against him as on this date. Learned counsel further submits that the petitioner is suffering from serious medical ailments and there is no chance that he will tamper with the evidence or influence the witnesses. In view thereof, learned counsel prays that the accused-petitioner may be enlarged on bail. 4. Learned Public Prosecutor strongly opposes the bail application. 5. This Court considered the nature of allegations as reported in the FIR, delay in reporting the incident and the fact that the petitioner is more than 60 years of age. After considering the overall facts and circumstances of the case and without commenting upon merits of the case, this Court is inclined to exercise its power under Section 483 B.N.S.S. and deems it just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is directed that accused-petitioner Shiv Charan son of Late Shri Ramkishan shall be released on bail, provided he executes a personal bond in a sum of ₹1,00,000/- with two sound and solvent sureties of ₹50,000/- each to the satisfaction of learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. The petitioner is [2026:RJ-JP:23367] (3 of 3) [CRLMB-8044/2026] further directed not to take undue advantage of liberty or misuse liberty. It is made clear that the observation as made by this Court in the bail application will not affect the trial of the case. (RAVI CHIRANIA (V.J.)),J 110/Manish
