1. Mr. Bharat Singh, learned counsel for the applicant.
2. Mr. Vijay Khanduri, learned Brief Holder for the State.
3. Present applicant Anas, S/o Jakir Husain is praying for bail in reference to FIR dated 05.07.2025, bearing FIR No. 0338 of 2025, P.S. Patel Nagar, District Dehradun wherein on completion of investigation the applicant has been charge sheeted for the offences punishable under Sections 117(2), 333 and 64 of BNS 2023.
4. It is argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated and CCTV footages have not been verified. He further submits that there is no eye witness of the incident and as per the medical report there is no sign of any sexual assault and the complainant who was examined as PW3 on 08.07.2026 have not support the case of the prosecution and victim infact sustain injuries when she slipped in the house and died at Chandigarh in the hospital during treatment. He further submits that the applicant is languishing in jail since 16.07.2025.
5. On the other side, Mr. Vijay Khanduri, learned Brief Holder for the State submits that after collecting all credible evidence charge sheet has been filed though the

2026:UHC:6187 complainant herself during her examination in chief on 08.07.2026 has not support the case of the prosecution.
6. After hearing the submissions of the
learned counsel for the parties and taking into consideration that the charge sheet has already been filed and the applicant have no criminal antecedent and the victim herself have not fully support the case of the prosecution though the trial is going on, this Court is of the view that at this stage when the present applicant is languishing in jail since 16.07.2025 he deserves for bail.
7. Accordingly without expressing any opinion on the merit of the case, the bail application is allowed.
8. Let the applicant ‘Anas’ be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
