This misc. bail application has been filed by the petitioners Tinna @ Aaris S/o Hanif and Aarif @ Paggal S/o Sabbir, who was arrested by the Police in connection with the FIR bearing No.0393/2018 dated 26.08.2018 registered at Police Station Kaman, District Bharatpur for the offences punishable under Sections 420 and 382 of IPC, 1860. 2. Learned counsel submits that the co-accused person has already been enlarged on bail by the Coordinate Bench of this [2026:RJ-JP:23438] (2 of 3) [CRLMB-8779/2026] Court while allowing the bail application in the year 2018 vide order dated 10.12.2018. Learned counsel further submits that petitioners have no criminal antecedents of any nature. In view thereof, learned counsel prays that the petitioners be enlarged on bail after imposing strict conditions. 4. Learned Public Prosecutor strongly opposes the bail application, however, could not dispute the fact that the co- accused has already been enlarged on bail by the Coordinate Bench of this Court and further that there are no criminal antecedents of any nature against the petitioners herein. 5. This Court, after considering the nature of allegations, the co-accused has already been enlarged on bail by the Coordinate Bench of this Court, noting the overall facts and circumstances of the case and without commenting upon the merits of the case, is inclined to exercise its power under Section 483 B.N.S.S. and deems it just and proper to enlarge the accused-petitioners on bail. 6. Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is directed that accused-petitioners Tinna @ Aaris S/o Hanif and Aarif @ Paggal S/o Sabbir shall be released on bail, provided each of them executes a personal bond in a sum of ₹1,00,000/- with two sound and solvent sureties of ₹50,000/- each to the satisfaction of learned trial Court for their appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. It is made clear that the observation [2026:RJ-JP:23438] (3 of 3) [CRLMB-8779/2026] as made by this Court in the bail application will not affect the trial of the case. 7. It is further directed that in case, the petitioner is found to be involved in any case during pendency of the trial, the bail granted to the petitioner shall stand cancelled automatically without reference to the Court.
