GP FOR FINANCE PLANNING The Court made the following: SRK, J W.P.No.22608 of 2026 3 O R D E R Heard learned counsel for the petitioner, the learned Assistant Government Pleader for the Panchayat Raj and Rural Development, the learned Assistant Government Pleader for Finance and Planning, and the learned Standing Counsel for Gram Panchayat. 2. This Writ Petition is filed seeking the following relief: “….to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in not making the payments for total amount of Rs.18,87,149/- (Rs.8,06,608/- + Rs.10,80,541/-) for land levelling in YSR Jagananna Colony, Lakshmipuram Village, Kruthivennu Mandal, Krishna District in Work ID No.065005LA105088 and Pallipalem, Kruthivennu Mandal, Krishna District in Work ID No.06506LA000875 as illegal, arbitrary and violation of Articles 14, 21 and 300A of the Constitution of India, and further direct the respondents to clear the bill of Rs.18,87,149/- (Rs.8,06,608/-+Rs.10,80,541/-) forthwith and to pass such other order or orders …” 3. The petitioner claims to be a Civil Contractor, used to execute civil contract works. The respondent No.4 issued Administrative Sanction Proceedings dated 18.09.2023 for the work of land levelling in YSR Jagananna Colony, Lakshmipuram Village, Kruthivennu Mandal and Pallipalem, Kruthivennu Mandal; that the respondent No.6 issued Technical Sanction Proceedings, dated 30.08.2025; that the petitioner executed the works under Work ID SRK, J W.P.No.22608 of 2026 4 Nos.065005LA105008, 06506LA000875 and completed the same within the stipulated time; that the respondent authorities inspected the works, obtained Quality Control Report and recorded the measurements in M-Book No.577A/22-23, and the respondent authorities have to pay Rs.8,06,608/- and Rs.10,80,541/-, totaling a sum of Rs.18,87,149/- for the said works. (b) It is the grievance of the petitioner that though he executed the entire works within time, an amount of Rs.18,87,1491/- was kept pending by the respondent authorities. Even though the petitioner approached the respondent authorities on multiple occasions, requesting for payment of aforesaid pending bill amount, they are not paying the said amount. According to petitioner, having executed the works satisfactorily, within the prescribed time, non- payment of the bill amount was arbitrary and unjustified. It was further contended that the delay in payment is causing severe financial hardship, necessitating the filing of the present Writ Petition seeking appropriate directions for release of the outstanding amount. 4. A perusal of the material on record goes to show that the respondent authorities assigned the contract works, as mentioned supra, to the petitioner. Grievance of the petitioner is that though he SRK, J W.P.No.22608 of 2026 5 executed the said contract works within the stipulated time to the satisfaction of the respondent authorities, the respondent authorities are not releasing the payment covered under the bill that was submitted by the petitioner for the amount spent by him for executing the work. 5. Having regard to the fact that in spite of granting number of adjournments, the respondent authorities neither secured written instructions nor filed counter-affidavits, the respondent authorities are directed to verify and pay the admitted amount for the works executed by the petitioner within a period of two (02) months from the date of receipt of the order. It is made clear that the petitioner shall execute an indemnity bond to the effect that in case, if it is found that the petitioner has not executed the works, he would repay the amount so paid. 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs of the Writ Petition.
