This writ petition is filed to direct the Respondent No.3 to investigate the Crime No.98 of 2023 dated 12.05.2023 against the Respondent Nos.4 and 5 of the offences punishable under Sections 447, 427 read with 34 of Indian Penal Code (for brevity ‘the I.P.C’). 2. As seen from the record, basing on the report of the petitioner, a case in Cr.No.98 of 2023 was registered of the offences punishable under Sections 447, 427 r/w 34 of I.P.C against the Respondent Nos.4 and 5 and since the investigating officer has not been proceeding with the investigation, petitioner filed this instant writ petition. 3. Learned Assistant Government Pleader for Home filed written instructions stating that the crime was investigated into and at the culmination of investigation, the case is referred as civil in nature, in view of the pendency of civil suits vide O.S.No.58 of 2019 and O.S.No.07 of 2023 and accordingly the report is submitted to the Sub-Divisional Police Officer, Kothapeta vide C.No.366/RFD/SDO-K/2023 dated 21.07.2023. As per the learned Assistant Government Pleader for Home, the said information is also furnished to the petitioner on 05.09.2023. 4. Learned counsel for the petitioner fairly conceded to record the written instructions filed by the learned Assistant Government Pleader for Home and 4 dispose this writ petition by giving liberty to the petitioner to take appropriate legal steps. 5. Recorded the submissions of the learned counsel for the petitioner as well as learned Assistant Government Pleader for Home. 6.
