Hon’ble Pankaj Purohit, J. 1. Mr. Vinay Kumar, learned counsel for the petitioner. 2. Mr. B.P.S. Mer, learned Additional C.S.C. for the State of Uttarakhand. 3. Petitioner is serving as Assistant Professor in State College of Nursing, Dehradun since September 2025. She is aggrieved by her transfer from Dehradun to State Nursing College, Almora vide order dated 30.06.2026. Thus, feeling aggrieved, she has approached this Court challenging her transfer. 4. It is contended that petitioner is a divorcee; however, she has been transferred without inviting option from her. It is further contended that petitioner has not completed normal duration of posting at Dehradun, therefore, her transfer to Almora is bad in the eyes of law. 5. Learned State Counsel submits that Almora is a Sugam place and petitioner has been transferred from one Sugam place to another and there is no prohibition in the Transfer Act against transferring a divorcee to a Sugam place. UKHC010127732026 2026:UHC:6306-DB 6. Learned counsel for the petitioner submits that petitioner has made representation to the Transferring Authority on 14.07.2026. 7. Learned State Counsel submits that decision on petitioner’s representation shall be taken expeditiously. 8. The writ petition is, accordingly, disposed of with a direction to the Transferring Authority to consider the representation submitted by petitioner on 14.07.2026, as per law, within one week. For a period of one week only, status quo as regards petitioner’s posting shall be maintained. (Pankaj Purohit, J.)
