2026:JHHC:1085 IN THE HIGH COURT OF JHARKHAND AT RANCHI W.P.(S) No. 5140 of 2022 ------ Goutam Kumar Baskey, son of late Ruplal Baski, resident of Sardiha, P.O Chamra Bahiyar, P.S. Jarmundi, District- Dumka. … Petitioner(s) Versus 1. The State of Jharkhand through its Chief Secretary, Govt. of Jharkhand, at Project Bhawan, Dhurwa, Ranchi. 2. Sr. Superintendent of Police, East Singhbhum at Jamshedpur, P.O and P.S. Sakchi, District East Singhbhum. ...Respondent(s) ------ CORAM : SRI ANANDA SEN, J. ------ For the petitioner(s): Mr. Ashim Kr. Sahani, Advocate. For the State AC to Sr. SC-III ------ 05/15.01.2026: Heard the parties. 2. The claim of the petitioner for grant of compassionate appointment was rejected on the ground that he has filed the application belatedly. 3. After going through the documents and record, I find that the documents speaks else. 4. Admittedly, the father of this petitioner who was in police department died on 16.5.2011. Annexure-A of the counter affidavit, is the document of January 2015, which clearly suggests that the petitioner had applied for Child Constable after attaining the age of 14 years. 5. Be it noted that there is a provision for appointment of child constable after attaining the age of 14 years. Thereafter the Step-mother of this petitioner claimed compassionate appointment for her nephew, which was absolutely impermissible in the eye of law. 6. Due to pendency of the said petition, the respondents kept the matter pending and thereafter again a request was made by the step mother for the appointment of this petitioner in the year 2021, which was considered by the respondents to be the fresh application for compassionate appointment and the same was rejected on the ground of belated filing. The rejection is absolutely bad as the application of the year 2021 cannot be said to be the original application seeking compassionate appointment. 7. From the letter of January 2015, which is Annexure-A, it is clear that way back in the year 2015, the petitioner applied for compassionate appointment for the post of child constable. Thus the ground in the rejection 1. order is non est in the eye of law, therefore, the same is set aside. 8. The respondents are directed to re-consider the case of the petitioner treating the application of the year 2015 as the original application and proceed further and pass a fresh order within eight weeks from the date of receipt of a copy of this order. 9. This writ petition stands disposed of accordingly. 15th January, 2026 (ANANDA SEN, J.) Anu/-Cp2. Uploaded on: 24.01.2026 2.
