Present contempt petition has been filed by the petitioners alleging willful and deliberate non-compliance of the order dated 02.01.2026 passed by this Court in Writ Petition (S/S) No.2358 of 2025, Dev Dutt and 15 others Vs. Uttarakhand State Cooperative Federation Limited through its Managing Director and others. The operative portion of the said order is reproduced hereinbelow:-
“The writ petition is, accordingly, disposed of with a direction to Managing Director, Uttarakhand Cooperative Federation to take decision on representation dated 23.12.2025, as per law, within eight weeks from date of presentation of certified copy of this order.”

It is contended by learned counsel for the petitioners that despite service of certified copy of the

23.12.2025 was not decided within the stipulated period of eight weeks. Learned counsel further submits that although the representation has subsequently been rejected, the order of rejection suffers from several infirmities and is not in conformity with the orders passed by this Court as well as by the Hon’ble Supreme Court and, therefore, the respondent-contemnor has committed contempt thereof.

Learned counsel for the respondent-contemnor submits that the representation of the petitioners has been decided in terms of order dated 02.01.2026 passed by the Co-ordinate Bench.

Having perused the order dated 02.01.2026 and the material placed on record, it is evident that a specific direction was issued to the Managing Director, Uttarakhand Cooperative Federation to take a decision, as per law, upon the representation dated 23.12.2025 within eight weeks from the date of presentation of the certified copy of the order. The representation having since been decided by the respondent-contemnor, the direction issued by this Court stands complied with. Once the representation has been decided, whether the decision taken thereon is right or wrong or suffers from any infirmity, cannot be gone into in the present contempt proceedings. If the petitioners are aggrieved by the order passed on their representation, it shall be open for them to assail the same before the appropriate forum, in accordance with law.

In view of the aforesaid, no further proceedings are called for in the present contempt petition. Accordingly, the contempt petition is closed. 2

The petitioners shall, however, be at liberty to take recourse to the appropriate remedy before the appropriate forum, in accordance with law, for redressal of their grievance.

Pending application, if any, stands disposed of accordingly.
