The petitioner is apprehending his arrest in connection with Complaint Case No.2220 of 2023, for offence registered under sections 26(1)(g), 41, 42 and 52 of Indian Forest Act, 1927 (Bihar Amendment Act, 1989) and Section 27, 29 and 51 of Wild Life Protection Act, pending in court of learned Chief Judicial Magistrate, Koderma.

Learned counsel for petitioner submits that only on suspicion, the petitioner has been implicated in this present case and the allegations are made that on the truck in question, scrap mica was being loaded on the instruction of the petitioner. He next submits that the petitioner has got no criminal antecedent as disclosed in paragraph no.14 of the petition. He then submits that the petitioner is earning his livelihood by way of doing labour work.
4. Learned State counsel opposes prayer and submits that the

allegations are there of loading the scrap mica on the instruction of the petitioner.

Considering that the petitioner has got no criminal antecedent as aforesaid and the petitioner was not present on the spot and the only allegation is made that on the instruction of the petitioner on the vehicle in question the scrap mica was being loaded and it has been pointed out that the petitioner is earning his livelihood by doing labour work, I am inclined to grant anticipatory bail to petitioner.

Accordingly, petitioner, above named, is hereby directed to surrender before learned court within four weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Chief Judicial Magistrate, Koderma, in connection with Complaint Case No.2220 of 2023, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
