Petitioner is serving as Surgeon in Department of Medical, Health & Family Welfare. He has been transferred from Sub-District Hospital, Prem Nagar, Dehradun to Sub-District Hospital, Mela, Haridwar vide order dated 29.06.2026. Thus, feeling aggrieved, petitioner has approached this Court. 4. It is contended that petitioner is suffering from lower back pain and petitioner’s wife is a serious patient, as she has recently undergone kidney transplant. 5. Learned State Counsel points out that petitioner has been serving at Dehradun since 2017 and he has been transferred as per provisions of Transfer Act. 6. Transfer is an incident of service UKHC010128852026 2026:UHC:6307-DB and after serving at Dehradun for nine long years, petitioner cannot question his transfer to some other place. State Government appears to have taken a sympathetic view in respect of petitioner and transferred him to Haridwar, which is only 40 kms apart from Dehradun. Thus, there is hardly any scope of interference. 7. The writ petition is, however, disposed of with liberty to petitioner to make representation to the Competent Authority within three days. If petitioner makes representation within stipulated time, then his representation shall be decided, as per law, within one week thereafter.
