order dated 30.07.2024 passed by this Court in CRR No. 862/2014.
2. This Court, vide order dated 30.07.2024, while partly allowing the criminal revision and sentencing the petitioner to the period already undergone, had
directed the petitioner to deposit the fine amount of Rs. 5,000/- for offence under Section 323 of the IPC, with direction that any fine amount deposited by the petitioner earlier shall be adjusted, for which one month time was granted from the date of passing of the order for depositing the said fine amount.
3.
Learned counsel for the petitioner submit that the direction issued by this Court regarding the payment of fine amount of Rs. 5,000/- could not be complied PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2026.02.25 16:22:50 +0530
2 within stipulated time of one month. As the petitioner is a resident of a rural area and was not in contact with the Counsel, as the Counsel did not have his current residential address. Further, due to extreme financial hardship, it took him a reasonable amount of time to arrange the said amount for deposit. Further, if the time is not extended, the petitioner faces the risk of undergoing the original sentence of one year of rigorous imprisonment, as per the default clause in the
order dated 30.07.2024. Hence, he prays that the time period for depositing the fine amount may be extended as the petitioner is willing to deposit the same.
4. Learned State counsel has no objection.
5. The prayer made by the petitioner appears to be reasonable. Hence, the petitioner is granted further two weeks and no more time from today to deposit the said fine amount as was ordered by this Court on 30.07.2024 in CRR No. 862/2014, failing which he shall undergo the sentence as has been ordered by the trial Court.
6. Accordingly, this Cr.M.P. stands disposed of.
7. Registry is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/-
