D/L42 27.01.2026 Bpg. dismissed C.R.M. (M) 66 of 2026 In Re: An application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (Corresponding to Section 439 of the Code of Criminal Procedure) filed in connection with Kashipur Police Station Case No.277 of 2023 dated 16.06.2023 under Sections 302/34 of the Indian Penal Code and 25/27 of the Arms Act and charge-sheet submitted under Sections 147/148/149/341/302/109/120B of the Indian Penal Code and Section 9B of the Explosives Act 1884; Nantu Molya alias Nantu Molla Versus The State of West Bengal Mr. Angshuman Chakraborty Mr. Shashanka Shekhar Saha. …for the petitioner. Ms. Amita Gaur Mr. Suruchi Saha. …for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 1 year 9 months and only two witnesses out of 58 witnesses have been examined till date. Except the petitioner and two others rest of the accused persons have been granted bail, as such, the petitioner may be released on bail. Learned advocate for the petitioner also submits that P.W.2 could not identify the present petitioner. Learned advocate for the State opposes the prayer for bail and submits the accused contributed to the delay and lastly the charge could be framed on 1st August, 2025. The evidence of two witnesses have been fixed on 19th January, 2026 and, as such, 2 according to the State, there was no delay on the part of the prosecution. So far as the present petitioner is concerned, attention of the Court was drawn to the evidence of one of the witness wherein the complicity of the petitioner and another has been shown to hurl bomb upon the deceased. Having regard to the complicity of the present petitioner, I am of the view that this is not a fit case for granting bail. Accordingly, the prayer for bail of the petitioner in CRM (M)66 of 2026 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
