In this criminal petition under Section 528, Bharatiya Nagarik Suraksha Sanhita [BNSS], 2023, the petitioner has sought quashing and setting aside of criminal proceedings of Special [NDPS] Case no. 54 of 2025 including the Charge-Sheet submitted in connection with Ratabari Police Station Case no. 130/2025, which has been submitted against four accused persons including the petitioner, finding a prima facie case established to proceed for Page No. 2/2 committing the offences under Sections 21[b]/25/29, NDPS Act, 1985. In the Charge-Sheet, the I.O. has mentioned the petitioner as an absconder and a prayer has been made to issue a warrant against the petitioner. 3. The Special Court, Sribhumi after registering Special [NDPS] Case no. 54 of 2025 on the basis of the said Charge-Sheet has, however, proceeded to issue notice to the petitioner fixing 05.02.2026 for his appearance. The learned counsel for the petitioner has submitted that he would not make any submission regarding quashing and setting aside of the criminal proceedings Special [NDPS] Case no. 54 of 2025, presently pending before the Special Court, Sribhumi with the further submission that the petitioner would make endeavour to appear before the Special Court on the next date of posting of the case on 05.02.2026 with a prayer to release him on bail upon appearance, no further order is necessary in this criminal petition.
