JUSTICE LALITHA KANNEGANTI - 3 - HC-KAR NC: 2026:KHC:16319 WP No. 2966 of 2022 ORAL ORDER The present writ petition is filed seeking the following prayer: "Wherefore it is most respectably prayed that this Hon'ble Court may be pleased to: (a) Issue a Writ of Mandamus directing to the Respondents No.1 to 3 to initiate the disciplinary action against the Respondents 4 and 5 for the unnecessary interference in the matter of civil in nature and for using the police power for illegal construction for hand in glove with the real estate developer, in the interest of Justice and Equity. (b) Issue of a writ of mandamus to the 5th Respondent to register the complaint filed by the petitioner vide Annexure-J and J1 dated 13.11.2021 and 27.12.2021, respectively and draw the FIR and take immediate action further provide proper police protection to the petitioner and to her family, in the interest of justice and equity. (c) Issue a writ of Mandamus directing the Respondents 1 to 3 to issue a Circular, wherein the protection to the purchaser/petitioner's property who has purchased the property through Bank auction, which are having a valid title deed in the interest of justice and equity. (d) Pass any order consequential relief or any other appropriate order or direction as this Hon'ble Court deems fit in the facts and circumstances of the case in the interest of Justice and Equity." 2. Learned High Court Government Pleader submits that as far as the first relief is concerned, the petitioner has to approach the authorities under Section 20D of the Karnataka Police Act. Coming to the second prayer, it is submitted that basing on the complaint given by the petitioner, the crime is registered i.e., Cr.No.22/2022 on the file of Malleshwaram Police Station. After a full-fledged enquiry, the police have filed the charge sheet in CC.No.15568/2023. Hence, nothing survives for consideration. 4. In the light of the above submission of the learned HCGP, the writ petition is disposed of giving liberty to the petitioner to avail appropriate remedy, in case he is aggrieved by any of the action of the respondents/police officers.
