This writ petition has been preferred by the petitioner under Article 226 of the Constitution of India, seeking following reliefs:- “10.1 That this Hon’ble Court may kindly be pleased to direct the respondents authority to grant appointment on compassionate ground to the petitioner in lieu of death of his father. 10.2 That, this Hon’ble Court may kindly be pleased to direct the respondents authority to consider and decide the pending representation/application of the petitioner dated 03.08.2018 and VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.02.19 11:37:02 +0530 2 02.06.2025” 10.3 That any other/relief order that may be deemed fit and just in the facts circumstances of the case including awarding of the cast of the petition may kindly be passed. 2. Learned counsel for the petitioner submits that father of the petitioner, namely, Late Shri Prem Singh Kunjam, while working as Sub-Forest Ranger Grade-III at Bagnadi Forest Range, Special Work, Chhuriya, District Rajnandgaon died in harness on 17.05.2018. Thereafter, the petitioner submitted his application for grant of compassionate appointment on 03.08.2018 i.e. within a period of 03 months from the date of death, however, till date no decision has been taken on the said application of the petitioner. Learned counsel further submits that the claim of the petitioner for grant of compassionate appointment was disputed by his brother, namely, Manish Kunjam, but subsequently, a consent letter (Annexure-P/3) has been executed on 30.05.2025 by the mother of the petitioner including his brother with regard to grant of compassionate appointment to the petitioner herein before the respondent No.03, but till date no order granting compassionate appointment to the petitioner has been passed. 3. Learned State counsel submits that earlier there was some dispute between the two brothers for grant of compassionate appointment on account of death of their father and the brother of the petitioner, namely, Manish Kunjam also filed an application under Section 372 of the Succession Act for issuance of succession certificate, but the same has been rejected. 4. Be that as it may, from the pleadings and the documents available on record in the present case, it appears that earlier there might be some dispute between the petitioner and his brother- Manish Kunjam for 3 getting the compassionate appointment, however, the document annexed at Page No.18 of this writ petition would show that a consent letter has been executed by the mother of the petitioner as also by his brother- Manish Kunjam with regard to grant of compassionate appointment in favour of the petitioner herein. As such, in light of the aforesaid facts and circumstances of the present case, the respondent No.03 is directed to consider and decide petitioner’s application for grant of compassionate appointment by specially taking into consideration the consent letter executed by the mother and brother of the petitioner herein, in accordance with law, by passing a reasoned and speaking order preferably within a period of 03 months from the date of receipt of copy of this order. 5.
