[2026:RJ-JP:23372] (2 of 3) [CRLMB-8805/2026] petitioners are the owners of the land and, therefore, whatever illegality they have committed will not create any right in favour of the complainants to lodge FIR against them. Learned counsel further points to the age of the petitioners herein and submits that there is no apprehension of affecting the investigation, witnesses, etc., and in view thereof, he prays that the petitioners be enlarged on bail by this Court.
3. Learned Public Prosecutor as well as learned counsel for the complainant strongly oppose the bail application, however, fail to dispute the fact that the petitioners herein are the owners of the land, in respect to which they made certain documents regarding mutation.
4. Heard learned counsel for the parties.
5. Considering the overall facts and circumstances, age of the petitioners, the fact that they are the owners of the land in question and without commenting upon the merits of the case, this Court, is inclined to enlarge the petitioners on bail.
