Rakib (Rejected) CRM (NDPS) 1747 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Palashipara Police Station case no. 04 of 2025 dated 03.01.2025 under Sections 21(c) of the of the Narcotic Drugs and Psychotropic Substances Act, 1985. Learned advocate appearing for the petitioner submits that petitioner is in custody for more than 13 months and has been falsely implicated in connection with the instant case. The recovery was around 9.30 pm and no independent witnesses were called and only police personnel were party to the seizure. Petitioner claims innocence and also submits that the CFSL Report do not reflect a clear picture regarding the nature of the contraband which has been seized. I have taken into account the materials appearing in the Case Diary and the factum of seizure in the present case which is of commercial quantity. At this stage, I am of the view that this is not a fit case from where the Court can come to a conclusion that Section 37 of NDPS Act is not attracted. 2 As such, the prayer for bail of the petitioner in CRM (NDPS) 1747 of 2025 is rejected. The investigating officer of the case is present with the original Case Diary, his further appearance before this Court is dispensed with. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
