The petitioner named above has been made accused in connection with Bagodar P.S. Case No. 251 of 2025 for the offences registered under Sections 69, 351(2) and 318(4) of the Bhartiya Nyaya Sanhita, 2023, pending in the court of Judicial Magistrate, First Class, Giridih. It is submitted by learned counsel for the petitioner that the prosecutrix is a major lady, aged 29 years, and there is a delay of three months in lodging the FIR. It is further submitted that it is counter blast to Bagodar P.S. Case No. 176 of 2025 which was lodged by the wife of the petitioner under Sections 126(2), 352, 79, 118(1), 117, 109, 351(2), 3(5) of BNS and Sections 3/ 4 of Jharkhand Prevention of Witch (Daain) Practices Act, 2001 against the sister of the informant and others. There is no date or time mentioned of the alleged sexual assault. Learned counsel for the State has opposed the prayer for bail. Considering the aforesaid facts and circumstances of the case, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each, to the satisfaction of learned Court below.
