Ms. Prajwal Sharma, Advocate, vice Mr. Vinod Sharma, Advocate, for the applicant/respondent. CMP No.7992 of 2026 The present application under Section 151 of CPC has been filed by the applicant/respondent for release of the awarded amount of compensation, which is lying deposited in the Registry of this Court. As per the applicant, he is in dire need of money to meet out his day-to-day expenses as well as for his medical treatment. Therefore, it is prayed that the entire balance amount of compensation may be released in his favour. The application is duly supported with the affidavit of the applicant/ respondent. 2. Learned Additional Advocate General has placed on record instructions dated 12.05.2026, wherein it has been stated that the matter is at government level for obtaining legal advice, which is still awaited. 3. Be it stated that the appeal was finally decided by this Court on 30.10.2025 and since then, nothing has been done by the non-applicants/appellants and for their non-action, the applicant/ respondent cannot be made to suffer as the notification under Section 4 of the Land Acquisition Act for acquiring the land of the applicant/respondent was issued as far back as in the year 2008 and the applicant/respondent cannot be deprived of the amount of compensation awarded to him by the learned Reference Court, which has been upheld by this Court, vide judgment dated 30.10.2025, just because of laxity on the part of the non-applicants/appellants. 4. Heard. Having perused the averments made in the application, which are duly supported with the affidavit of the applicant/respondent, this Court finds it in the interest of justice to release the balance awarded amount of compensation alongwith up-to-date interest in favour of the applicant/ respondent, after proper verification and identification by remitting the same to his bank account, details whereof have been given in para-3 of the application.
