learned counsel for the petitioner. Also heard Mr. M. P. Goswami, learned Additional Public Prosecutor for the State.
2. This is an application u/s 482 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 for granting pre-arrest bail to the accused/petitioner in connection with Azara P.S. Case No. 55/2026 u/s 69/117(2)/109(1)/3(5) of Bharatiya Nyaya Sanhita (BNS), 2023.

It is submitted by Mr. Konwar that from the contents of the FIR itself it is seen that there was a consensual relationship between accused no. 1 and the informant in this case and since last 4 years they were in relationship. However, it is a fact that there was a love relationship between the accused no. 1 and the victim and there was a talk of marriage also. But, subsequently it has come to the knowledge of the petitioner that the victim was a married woman and for which the family members of the accused/petitioner refused to marry the victim. On that grudge only the FIR has been lodged with some false and concocted allegation. However, the petitioner is ready and willing to extend his cooperation in further investigation of this case, if he is granted with some interim protection.

The learned Additional Public Prosecutor upon perusal of the case diary, submits that as per the statement of the victim the accused gave her cut injuries because of which she was bleeding from her hand. However, there are also statements of other witnesses who have stated that the said injuries are
Page No.# 3/3 self-inflicted and moreover, as per medical report, said injuries are of a simple nature.
5. Pursuant to interim protection granted by this Court the petitioner has appeared before the I.O. and his statement has been recorded.
6. Having regard to the above as well as the nature of the allegations, custodial interrogation on the petitioner may not be necessary accordingly, prayer for pre-arrest bail is allowed and the order of interim pre-arrest bail dated 27.05.2026, is hereby made absolute, under the same terms and conditions.
7. The petition stands disposed of accordingly.
