Considering the nature of the relief sought for, notice to the 3rd respondent is dispensed with. 3. The defacto complainant cultivates agricultural land in his village by giving a weekly share of income to the landowners. The land was recently purchased by the 1st petitioner herein, who threatened the defacto complainant not to cultivate it. On 29.01.2026 at about 08.00 2/6 https://www.mhc.tn.gov.in/judis Crl.O.P(MD)No.2459 of 2026 a.m., when the defacto complainant and his wife Letchumi went to the field to cut grass, an unknown person, allegedly instigated by the 1st petitioner, assaulted the defacto complainant, dragged him using a two wheeler, pushed his wife to the ground, kicked and trampled her in the mud, and the 1st petitioner abused and threatened the defacto complainant using filthy and unparliamentary words. Based on the complaint lodged by the defacto complainant, FIR was registered in Crime No.24 of 2026 for the offences under Sections 191(2), 296(b), 115(2), 351(2), 138, 137(2) of BNS 2023, Section 4 of TNPHW Act, 2002 and Sections 3(1) (r), 3(1) (s), 3(1) (g) and 3(2) (va) of SC / ST (POA) Act, 1989. 4. Heard the learned counsel on either side and carefully perused the materials available on record. 5.
