The order impugned in the present appeal was passed directing the District Inspector of Schools (S.E.), Jhargram to make an endeavour to find out ‘willing’ teacher from neighbouring schools to man the post of the writ petitioner/appellant herein which is to be created on transfer of the appellant. Aggrieved by incorporation of the word ‘willing’, in the order impugned, which does not feature in relevant notification dated 3rd January, 2022, the appellant has approached this Court. Mr. Lahiri, learned advocate appearing for the appellant submits that during pendency of the appeal, the respondent no.5 has issued a memo dated 9th September, 2025 to the respondent no.7 intimating inter alia that one Shyamal Kumar Karak, Assistant Teacher serving at Raghunathpur Junior High School has been placed to render his service at Kechandra Junior High School for three days in a week on a stop gap arrangement under the same circle and development block, with immediate effect and until further orders. Subsequent thereto, the Member Secretary, Ad- hoc Committee, Kechandra Junior High School has intimated the respondent no.5 by a memo dated 15th September, 2025 that Shri Shyamal Kumar Karak has joined the concerned post at Kechandra Junior High School on 12th September, 2025. Let the said documents, as produced, be kept on record. In view thereof, the appeal and application for stay are disposed of directing the respondent nos.3 and 5 to take all follow up steps strictly in terms of the notification no.09-SE dated 3rd January, 2022, as expeditiously as possible, preferably within a period of four weeks from the date of communication of this order. There shall, however, be no order as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the parties, upon compliance of all requisite formalities.
