Bail petition filed on behalf of the petitioner- Rahul Das @ Rahul Kumar Das, who is in custody since 30.07.2025 in connection with Adityapur P.S. Case No. 237 of 2025 for the offence registered under Sections 64, 351(2) of the BNS, 2023 later on, Section 64(1) of the BNS was added pending in the Court of learned Chief Judicial Magistrate, Seraikella is pressed into motion.
Informant is a major lady aged about 24 years and happens to be Mouseri Bhabhi of the petitioner. As per the FIR, under force and duress, he committed rape with her on 29.06.2025.
It is submitted by the learned counsel on behalf of petitioner that there is an inordinate delay of 26 days in lodging the FIR without any explanation for the same. As per the allegation, the incidence took place on 29.06.2025, whereas the marriage of the petitioner was solemnized on 4th July, 2025 and an informatory petition was given by this petitioner before the Chief Judicial Magistrate on 18th July, 2025 which was registered as Misc. (Cr.) Case No.2908 of 2025, wherein it has been stated by him that because of financial dispute, the victim had threatened to implicate him in a false case. Instant case has been lodged thereafter.
Learned A.P.P. opposed the bail petition.
There is an inordinate delay in lodging the FIR without any explanation for the same and an informatory petition was filed by the petitioner before the institution of the case. Under the circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
