ORDER 23.02.2026 The auction buyer in a SARFAESI proceeding is knocking at the doors of Writ Court with the following prayers: “In the facts and circumstances narrated above it is therefore, prayed that this Humble Court may graciously be pleased to admit this writ petition, call for the necessary record and after hearing may be issued writ of mandamus or any other suitable writ(s) may be issued with direction to the opp-parties-to take appropriate step regarding upon the representation filed by the petitioner before Opp.parties, and to render all possible assistance to the petitioner to protest his right. And may further be pleased to pass any other order(s), direction(s) as deemed fit and proper.” 2. Learned counsel for the Petitioner argues and we agree that the subject representation of his client for taking further steps in terms of the auction held on 07.01.2026 needs to be considered by the OP-Bank in accordance with law. Representations of the kind cannot be kept in limbo ad infinitum, argues the counsel. 3. Notice to OPs is dispensed with regard being had to the innocuous nature of prayer, in as much as it is for a direction to pass order on the subject representation, all contentions being kept open. p. 2 In the above circumstances, writ petition is disposed off directing OPs to take a call on the subject representation within an outer limit of six weeks. All contentions in that regard are kept open. It is open to the OPs to seek rescinding of this ex parte order, if grounds do exist therefor.
