This bail application has been filed on behalf of Nageshwar Bhuiyan and Karu Bhuiyan @ Karu Kumar who are in custody since 01.09.2025 in connection with Domchanch P.S. Case No. 71 of 2025 for the offence registered under Sections 303(2), 317(2) and 3(5) of BNS, 2023 pending in the Court of learned ACJM, Koderma. As per the FIR, it is alleged that sixteen pipes of water supply scheme under Jal Jeevan Mission stacked by the contractor of M/s A.K.G. Construction & Developers Pvt. Ltd. were stolen and while being transported by Truck, the same were seized by the Police. Both the petitioners are said to be involved in the alleged offence. It is submitted by the learned counsel on behalf of petitioners that there is no direct eye witness to the incidence and case is based on circumstantial evidence. The only material is the disclosure statement made by co-accused person Learned A.P.P. for the State opposed the prayer for bail. Under the circumstances, the above-named petitioners are directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) each with two sureties of the like amount each to the satisfaction of the Court below.
