Ms. Rituparna Ghosh Mr. Saptarshi Chakraborty …for the State. 1. Learned counsel appearing for the petitioner submits as follows. The petitioner is the alleged paramour of the wife of the victim. The incident happened after 14 years of marriage. It is alleged that the victim committed suicide because of his wife was having an illicit affair with the present petitioner. The wife was granted anticipatory bail by this Court on 12/2/2026 in CRM (A) 351 of 2026. 2. Learned counsel appearing for the State opposes the prayer for anticipatory bail. She relies on the statements of witnesses and the post-mortem report. She submits that there is a suicide note and other statements pointing to an illicit relation between the present petitioner and the wife of the victim. 3. The daughter of the victim apparently did not support such stand in her statement recorded before the learned Magistrate, as would appear from the case diary. 2 4. It also appears that the wife of the victim was earlier granted anticipatory bail by this Court. 5. It will be for the Courts to finally decide whether there is any element of abetment of suicide in this case. 6. However, considering the above and the other materials available in the case diary, I do not think that custodial interrogation of the petitioner is required in this case and I am inclined to grant anticipatory bail to the petitioner. 7. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioner shall cooperate with the investigation and shall not threaten or intimidate the witnesses. The petitioner shall meet the Investigating Officer once a week till submission of report in final form. 8. Accordingly, the application for anticipatory bail is allowed. 9. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities. (Jay Sengupta, J.)
