The petitioner is apprehending his arrest in connection with Dhurki P.S. Case No. 93 of 2025, registered under sections 318(4) of BNS pending in the Court of learned Judicial Magistrate, Ist Class, Garhwa. 3. Learned counsel for the petitioner submits that the petitioner was 4th Grade employee of the Circle Office, Garhwa and allegations are made of digging the well by using J.C.B machine however, the petitioner is nothing to do with the said allegation. He further submits that petitioner has got no criminal antecedent which is disclosed in para 9 of the petition. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail. 4. Learned counsel for the State opposes the prayer and submits that allegations are there of using J.C.B machine in digging the well. 5. Considering that petitioner is the 4th Grade employee of the Circle Office, Garhwa and allegations are made of digging the well using the J.C.B machine. Prima facie, it appears that J.C.B machine cannot be used on the instruction of the petitioner and petitioner has got no criminal antecedent which is disclosed in para 9 of the petition and in that view of the matter, petitioner is directed to surrender before the learned court within two weeks ( 2026:JHHC:2074 ) from today and the learned court shall release the petitioner on terms and conditions and sureties as learned court deems fit and proper. 6.
