This bail application has been filed by the applicant Rahul S/o Iliyas @ Illa, who was arrested by the police in connection with the FIR No.0060/2022 registered at Police Station Sikari, District Bharatpur for the offences punishable under Sections 143, 341, 323, 336, 427 & 379 of IPC. The bail application of the petitioner was rejected by the learned Additional District and Sessions Judge Brijnagar, District Deeg vide order dated 01.06.2026, thereafter, the petitioner has preferred this bail application under Section 483 of B.N.S.S.

Learned counsel submits that the Police arrested the petitioner in connection with FIR registered in the year 2022.
Learned counsel submits that all other co-accused named in the FIR have already been enlarged on bail by Coordinate Bench of this Court. Learned counsel further submits that as far as the
[2026:RJ-JP:23294] (2 of 2) [CRLMB-9173/2026] petitioner is concerned, was not named in the FIR and he has falsely been implicated in this case. In view thereof, learned counsel prays that the petitioner be enlarged on bail.
4. Learned Public Prosecutor strongly opposes the bail application.

This Court, after considering the nature of allegations and the fact that the petitioner was not named in the FIR and other co-accused have already on bail in terms of order of a Coordinate Bench of this Court, also after considering the overall facts and circumstances of the case, is inclined to exercise its power under Section 483 B.N.S.S. and deems it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is directed that accused-petitioner - Rahul S/o Iliyas @ Illa shall be released on bail, provided he executes a personal bond in a sum of ₹1,00,000/- with two sound and solvent sureties of ₹50,000/- each to the satisfaction of learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. The petitioner is further directed not to take undue advantage of liberty or misuse liberty. It is made clear that the observation as made by this Court in the bail application will not affect the trial of the case.
