CORAM:
MR. JUSTICE R.K. PATTANAIK
Order No.
ORDER 03.02.2026
02.
1. Both the ABLAPLs are disposed of by the following common order.
2. Heard Mr. Panda, learned counsel for the petitioners and Mr. Brahma, learned ASC for the State. p. 2
3. Instant petitions under Section 482 BNSS are filed for pre-arrest bail of the petitioners in connection with Maitri Vihar P.S. Case No.441 of 2025 corresponding to C.T. Case No.2047 of 2025 pending in the file of learned S.D.J.M., Bhubaneswar on the grounds stated therein.
4. Perused the FIR as at Annexure-1. It reveals that the assault was by means of a blade with cut injury received by the informant in his hand. Learned counsel for the petitioners submits that the informant has not received grievous injury and the allegations in the FIR at Annexure-1 are false and it has been lodged on account of previous animosity between the parties. On a reading of the FIR i.e. Annexure-1, this Court finds that a cash of Rs.10,000/- has been snatched away from the informant and assaulted him and he received a cut wound in his hand caused by a blade. It is submitted to the Court that the principal accused is responsible for the incident and his name is in the FIR. Nevertheless, considering the claim that the petitioners are first-time offenders and recording the objection of the State, this Court is of the view that they should be
directed to be released on bail upon their surrender before the court concerned instead of pre-arrest bail but such release should be with stringent conditions imposed.
5. Accordingly, it is ordered.
6. In the result, ABLAPLs stand disposed of with the direction as aforesaid. It is further directed that in the event, the petitioners surrender before the court of learned S.D.J.M., p. 3 Bhubaneswar within a fortnight from today, they shall be released on bail in connection with Maitri Vihar P.S. Case No.441 of 2025 corresponding to C.T. Case No.2047 of 2025 subject to them furnishing a bail bond of Rs.20,000/- (Rupees twenty thousand) each with one solvent surety for the like amount each to the satisfaction of the learned court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, they shall report to the I.O. for the purpose of investigation once in 10 days’ time and to continue to do so, till the same is over and to furnish an undertaking that they shall not pick up any quarrel with the injured informant or to cause any harm to him, in any manner whatsoever, while on bail.
7. Issue urgent certified copy as per rules.
