The grievance of the petitioner who is serving in the Indian Army as Lance Naik, (L/NK), presently posted at Bathinda, Punjab, is that, his application for grant of agricultural land has been rejected by the impugned endorsement at Annexure-G dated 17.09.2021, on the ground that no lands are available in Periyapatna Taluk, as sought for by the petitioner. 3. It is to be noticed that the State Government has issued a circular that in such cases where lands are not available for grant, such applicants should be offered a residential site. No such information is forthcoming from the impugned endorsement. 4. It is also the contention of the learned counsel for petitioner that the lands are indeed available as found at the Annexure-J series RTCs. - 4 - HC-KAR NC: 2026:KHC:8110 WP No. 663 of 2026 5. Having regard to the contentions raised herein above, writ petition stands disposed of while setting aside the impugned endorsement at Annexure-G dated 17.09.2021, with a direction to respondent No.3 - Tahsildar, Periyapatna Taluk, respondent No.2 - Deputy Commissioner, Mysuru District, to reconsider the application of the petitioner in the light of the observations made hereinabove and while looking into the RTCs produced by the petitioner at Annexure-J series. If such lands are available, then the authority may proceed to grant lands in favour of the petitioner or the petitioner should be offered a residential site in terms of the circular issued by the Government. The entire exercise should be completed as expeditiously as possible and at any rate within a period of three months from the date of receipt of a copy of this order.
